Anatolia American University Notice regarding the Council of State Decisions and the Ministry of Education Announcement on University Legal Entities (U.L.E.) licenses.

Anatolia American University is closely monitoring developments concerning the recent decisions of the Council of State regarding the not-for-profit, not-state universities / University Legal Entities (U.L.E). As the complete text of the Council of State decisions has not yet been published, a comprehensive assessment of their content and of the specific findings concerning Anatolia American University is not yet possible.

According to the announcement issued by the Council of State and the announcement issued by the Ministry of Education, Religious Affairs and Sports,and the announcement issued by the Ministry of Education, Religious Affairs and Sports, on 13 August 2026, the Council of State decisions do not contest the constitutionality of the legal framework governing the operation of U.L.E.; instead, they focus on specific implementation issues and regulatory acts.

In this context, the clarifications and assurances provided by the Ministry of Education, as set out in its announcement, are particularly significant:

• “The constitutionality of the institutional framework governing Universities Legal Entities is reaffirmed. Not only is there no doubt raised regarding the constitutionality of the relevant provisions of Law 5094/2024, but, on the contrary, the rulings of the Plenary Session of the Council of State are explicitly reiterated regarding the establishment and operation of foreign university branches in the form of University Legal Entities”.
• “The ground for annulment concerning non-accreditation of the offered academic programs offered by either the parent institution or by the competent accreditation body of its home state is dismissed”.
• “The deficiencies identified by the Court do not pertain to Law 5094/2024, but rather to specific issues of administrative procedure. […] Therefore, as evidenced by the content of the decision, these are matters concerning the implementation of the institutional framework and not issues concerning the law itself. This distinction is essential and does not justify interpretations or headlines that may create a different impression regarding the content and scope of the Council of State decisions.”
• “In any event, within the scope of each authority’s respective responsibilities, all necessary actions will be taken immediately to safeguard students’ rights and ensure the uninterrupted continuation of their studies. No student will lose the academic year.”
